FAMILY MEDIATION SCHEME
Litigation of family disputes can be expensive, protracted and exact a significant emotional toll on the parties involved. Mediation is an effective and efficient way to help resolve these disputes, regardless of whether the parties have commenced litigation.
SMC has developed the Family Mediation Scheme to help family members resolve their disputes amicably, and in a faster and cheaper manner. Matters that can be mediated include a wide range of complex issues such as the division of family assets, spousal maintenance, custody of children (including international child abduction cases) as well as wills & probate matters.
The aim of the Family Mediation Scheme is to:
Encourage a constructive and conciliatory approach to the resolution of family disputes;
Resolve family disputes in an effective and timely way;
Help maintain long-term family relationships and reduce emotional turmoil for parties; and
Ensure that costs are kept affordable for parties.
Under this Scheme, SMC will appoint experienced mediators with the requisite family law expertise from our Family Panel. With at least one full day set aside to help families resolve their differences, mediation can assist you to increase the chances of settlement and result in solutions which better satisfy the interests of parties without further damage to your relationships.
Family Justice Courts (FJC)- Ordered Mediation With effect from 1 October 2016, in partnership with the Family Justice Courts, SMC will be a service provider for suitable family cases ordered by the courts to attend private mediation. Collaborative Family Practice (CFP) is an interest-based approach to negotiations dealing with matrimonial disputes and is a process that is undertaken before the start of any court proceedings.
With the support of the State Courts of Singapore and The Law Society of Singapore, SMC’s CFP service aims to assist couples to reach an agreement, which meets the needs of all parties, thus avoiding the acrimony caused by the litigation process.
It involves specially trained CFP lawyers and other family specialists such as financial advisers and child specialists as necessary, assisting the parties to negotiate an agreement that suits your family.
A unique feature of this process is that CFP lawyers cannot represent their clients in future litigation if settlement is not reached. This provides a greater incentive for parties and lawyers to settle all their disputes.
Unlike matrimonial litigation, CFP is a much less stressful and less hostile process. It allows parties to maintain a civil relationship with each other, which is particularly important if you have children. The process is also confidential and may well be cheaper and faster than going to court.
The members of SMC’s Panel of CFP Lawyers are practising family lawyers. Many are also accredited SMC mediators who have undertaken specialist training.
Parties will enjoy an hourly rate of $428 (inclusive of GST) where SMC refers a CFP lawyer and/or other professional to you. Please note that a deposit would be collected once the lawyers and/or other professional are appointed.
