Introduction
Alternative Dispute Resolution or ADR refers to a range
of processes (other than litigation) that are designed to
resolve differences. In most cases, ADR is flexible,
effective and efficient. The ADR services provided by the
SMC include the following:
Mediation is a voluntary means of dispute resolution in
which the parties to a dispute engage the assistance of an
impartial third party (called the Mediator) to facilitate
negotiations between them with a view to resolving their
dispute privately and in an amicable manner.
The focus is not on who is right or wrong, nor on who has a
stronger or weaker case in court. Rather it is on how the
parties can move forward and put the dispute behind them.
The Mediator helps the parties to adopt a problem-solving
approach, move away from their respective positions and
focus on their interests, needs and concerns.

Neutral Evaluation is a process in which the parties to a
dispute obtain an objective, non-binding opinion on the
merits of their case from an independent third party (called
the Evaluator) to assist them in resolving their dispute
privately and amicably. All the parties to the dispute have
to agree to have the issues in dispute evaluated since
Neutral Evaluation is a voluntary process.

The Singapore Domain Name Dispute Resolution Policy ("SDRP")
provides a framework for resolving ".sg" domain name
disputes. It has been adopted by the Singapore Network
Information Centre (SGNIC) Private Limited ("SGNIC"), the
registration authority for ".sg" domain names, and provides
a cheap and quick mechanism for the parties to resolve their
disputes concerning the use of ".sg" domain names. The SDRP
is implemented by the SMC through the Singapore Domain Name
Dispute Resolution Service (or "SDRP Service").

DisputeManager.com is a portal that offers a
comprehensive suite of online ADR services and is the first
of its kind in Asia. It was developed with the support of
the Ministry of Law and the Singapore Academy of Law, and
was launched by the Honourable Chief Justice Yong Pung How
on 31 July 2002. Using DisputeManager.com, the parties to a
dispute can now register, file a case and resolve their
disputes online by way of e-settlement, Mediation or Neutral
Evaluation. The parties can similarly register at
DisputeManager.com for the Singapore Domain Name Dispute
Resolution Service.

e-Settlement is designed primarily for disputes involving
simple monetary claims between two parties. Essentially, the
parties make an offer and demand using an automated system.
If the offer and demand are within a certain range, the
system will indicate that there is a settlement at the
mid-point between the offer and demand.

Med-arb (or mediation-arbitration) is a hybrid resolution
process that brings together the elements of both mediation
and arbitration. In med-arb, the parties will first attempt
to resolve their dispute by mediation. Where the mediation
does not result in a settlement, the parties will proceed to
arbitration.
